GENERAL CONTRACTING CONDITIONS OF THE VIRTUAL STORE searacollection.com
The contractual document that will govern the contracting of products and services through the searacollection.com website is set out below. The acceptance of this document implies that the BUYER
- Have read, understand, and agree with this text.
- That it is a person or entity with sufficient capacity to contract.
- That assumes all the obligations set forth herein.
These conditions will have an indefinite period of validity and will be applicable to all contracts made through the SELLER's website searacollection.com.
THE SELLER reserves the right to unilaterally modify such Conditions, without this affecting the goods or promotions that were acquired prior to the modification.
1- Identity of the parties
On the one hand, THE SELLER or supplier of the goods is FLORBELA DO CEU ARRENEGA SILVESTRE, with registered office at Calle Camino Ancho, 1, Vivienda 38, 28109 Alcobendas (Madrid), with NIF 54978467A.
And on the other hand, The BUYER (or simply the client), either as a guest or registered user on the searacollection.com website through a form for creating an account on searacollection.com, over which have full responsibility for use and custody, being responsible for the veracity of the personal data provided to the SELLER.
2- Object of the Contract
The purpose of this contract is to regulate the contractual relationship of sale born between the SELLER and the BUYER now in which the latter chooses the product, transport, payment method and presses the respective order confirmation button.
The contractual relationship of sale entails the delivery, in exchange for a certain price and publicly exposed through the website of a specific product.
3 - LANGUAGE AND DURATION OF CONTRACT
Regardless of the possible translations of the section of these general conditions of sale, the official language of the contract will always be the Spanish version.
As contract duration we understand all the phases between the request of the initial order until the effective delivery of the requested products by the seller and the total payment of the agreed price by the client.
4 - MINIMUM CONTRACT AGE
According to art.1263 of the Civil Code, non-emancipated minors and the disabled cannot enter distance sales contracts without the express consent of their parents or guardians.
By accepting these general conditions of sale, the Client declares that they are of legal age (at least 18 years old) and have the legal capacity to acquire the services and/or products offered through this website, and that they understand and understand the general conditions in its entirety.
5- HIRING PROCEDURE
In accordance with the requirements of art. 27 of Law 34/2002 on Services of the Information Society and Electronic Commerce and other affected regulations, you are informed that the contracting procedure is carried out once the following steps have been completed:
- Within the online store (http://searacollection.com), select a product by clicking on it.
- Once this action is done, a screen will appear asking us if we want to add the product to the cart (to continue buying more products) or buy now, to go directly to the final payment process.
- If we decide to buy now, a screen will appear where the first thing we must do is enter our name, surname, and shipping address. Next, we will proceed to press the Continue with Shipment button.
- After completing the previous step, the screen will appear to enter the shipping method among those available, and we will click on Continue with the payment.
- On the next screen, we will choose a payment method among the existing ones (paypal, credit card... etc.), and a billing address (it can be the same as the shipping address or another).
- Once this is chosen, we must accept the terms of sale, and, if we are satisfied, press the button Pay now or finish the order (which will depend on the payment method chosen).
- Depending on the chosen payment method, the system will refer us to one or another electronic payment platform, where we must proceed to the final payment.
- A message will be sent to the BUYER's email address with the details of the purchase made, including the unique identification code that will allow them to identify their purchase.
6 - Price
The prices indicated for each product include Value Added Tax (VAT) and in any case will be expressed in the Euro currency (€).
The prices applicable to each product will be those published on the website and applied automatically in the contracting process.
THE SELLER reserves the right to modify the commercial offer of the website (modifications on products, prices, promotions, and other commercial and service conditions) at any time, although such modifications will not apply to contracts already made.
The contents of the website could, on occasions, show provisional information about the nature of some products. If the information provided does not correspond to the characteristics of the product, the customer will have the right to cancel their purchase at no cost on their part.
All payments received by the SELLER will entail the issuance of a receipt in the name of the BUYER. Such receipt will be included in the order sent.
For any information about the order, the BUYER may contact via email to the e-mail address firstname.lastname@example.org. In any case, the code or order number that was assigned and indicated in the purchase confirmation email must be indicated in the subject of the message.
7 - AVAILABILITY
If any of the products is not available at the time of the order, we will try to dispose of it as soon as possible whenever this is feasible. If we are unable to dispose of that item again, we will notify the customer as soon as possible.
8 - SHIPPING AND DELIVERY TIME
The item will be shipped once the full amount has been paid by the customer.
Shipping costs are included in the price of the product, with a minimum purchase of €100, for lower purchases shipping costs are calculated by weight and geographical area and can be seen before the payment option.
Orders will be sent within a period not exceeding 2/3 working days in Peninsula and Balearic Islands, 4/10 working days for Canary Islands and 3/7 working days to European Countries, we do not ship to other regions.
The delivery time will vary depending on the availability of the products. The shipment will be processed as soon as possible, in case it cannot be done, the client will be duly informed.
In addition, the term may vary depending on the nature of the order (customized products, textiles, etc.). In case of doubt, consult the SELLER through any of the communication channels and you will be given a deadline as approximate as possible.
Delivery of orders will be made to the delivery address freely designated by the BUYER. In this way, the SELLER does not assume any responsibility when the delivery of the product or service does not occur because of the data provided by the BUYER being false, inaccurate, or incomplete or when the delivery cannot be made for reasons beyond the control of the SELLER, or the distribution company designated for this purpose, such as the absence of the recipient. If the order is not received, the return costs to the SELLER will be paid by the BUYER in the same amount as the initial shipping costs.
9 - Right of return
Can I return the product if I am not convinced when I receive it?
If for any reason the Buyer does not agree with what was purchased, he can choose to return the product.
If the return is due to a change of mind, the customer has a period of 15 calendar days from the time of receipt of the merchandise and must notify Seara Collection in advance by sending an email to SearaCollection@gmail.com.
The return will only be accepted if the returned product is in perfect condition, in its original packaging and within the previously indicated exchange period.
The customer will bear the expenses generated by this return.
The Buyer may choose to request a product in exchange for the one that is returned, or request a refund of the amount paid (which will be done within a maximum period of 15 business days from receipt of the product in our warehouse)
How do I return the product if it has arrived defective?
When buying our products, you must understand that they are products that may have variations in tonality and design, because reactive glasses made with natural products are used, to keep the ecological footprint low, or zero.
Color variation and finish enhance the unique beauty of these products, produced through manual processes.
We would like these flaws to be understood as part of the identity of our collections.
If the reason is due to a breakage (such as broken crockery), it must be notified within the first 24 hours of receipt, attaching a photograph of the product to the email. email@example.com
The return will only be accepted if the returned product is in its original packaging and in the same conditions as when it was received.
Seara Collection will bear the expenses generated by this return.
The Buyer may choose to request a product in exchange for the one that is returned or request a refund of the amount paid (which will be done within a maximum period of 15 business days from receipt of the product in our warehouse).
10 - RIGHT OF WITHDRAWAL
To exercise the right of withdrawal, the BUYER has 14 calendar days from the date of receipt of the product. If you wish to exercise it, you must inform the SELLER by email to firstname.lastname@example.org with the subject Withdrawal. In that case, the SELLER may contact you to inform about the steps to follow, and the BUYER must bear the costs of this withdrawal.
In any case, the product must be returned in perfect condition, with its original packaging and with the purchase receipt.
The SELLER will return the amounts received through payment by the same payment method from which the purchase was made, within a maximum period of 14 days from the time the BUYER communicates his desire to exercise the Right of Withdrawal. Likewise, once the products have been delivered or returned, a corrective receipt will be sent to the Buyer.

11 - WARRANTY
All products offered are completely original, unless otherwise indicated. As they are new products, they have a 2-year guarantee from the date the product was delivered, where the SELLER will be responsible for any lack of conformity or defects in them.
12 - complaints and claims
For any information about the order, complaints and claims, the BUYER may contact via email to the e-mail address firstname.lastname@example.org. In any case, the order code that was assigned and indicated in the purchase confirmation email must be indicated in the subject of the message.
13 - DATA PROTECTION

Applicable law and jurisdiction
These conditions will be governed or interpreted in accordance with Spanish legislation in what is not expressly established. The SELLER and the BUYER agree to submit any dispute that may arise from the provision of the products subject to these Conditions to the Courts and Tribunals of the BUYER's domicile. If the buyer is a company or professional, the contract shall be presumed to be held at the SELLER's address.
If the BUYER is domiciled outside of Spain, the SELLER and the BUYER expressly waive any other forum, submitting to the Courts and Tribunals of the SELLER's domicile.
